1. Introduction
Welcome to Zabeel Cars and Accessories LLC (“we,” “us,” or “our”), a registered business operating in Nairobi, Kenya. These Terms and Conditions govern your use of our services, website (zabeel.ke), mobile communications, and in-person transactions. By engaging with us—whether online, via phone, WhatsApp, or at our workshop—you agree to be bound by these terms.

If you do not agree, please refrain from using our services.

2. Services Offered
We provide:

  • Supply and installation of genuine and high-quality car accessories and spare parts
  • Electrical and mechanical vehicle repairs
  • 24/7 emergency roadside assistance (including battery replacement and jump-starts)
  • Mobile diagnostics and doorstep service across Nairobi

All services are subject to parts availability, technician scheduling, and vehicle accessibility.

3. Pricing & Payment

  • All prices are quoted in Kenyan Shillings (KES) and are inclusive of VAT where applicable.
  • Prices may change without notice due to market fluctuations, but confirmed quotes remain valid for 48 hours.
  • Payment is due at the time of service completion unless a prior credit agreement exists in writing.
  • We accept: M-Pesa, bank transfer, cash, and mobile money.
  • No hidden fees — you’ll receive a clear breakdown before any work begins.

4. Warranty & Returns
a) Spare Parts & Accessories:

  • Genuine parts carry the manufacturer’s warranty (typically 6–12 months).
  • Aftermarket parts include a 30-day limited warranty against defects.
  • Returns/exchanges require proof of purchase and must be requested within 7 days for unused, uninstalled items in original packaging.

b) Repair Services:

  • All mechanical and electrical repairs include a 30-day service warranty on labor.
  • Warranty is void if:
    • The vehicle is serviced by another party during the warranty period
    • Damage results from misuse, accidents, or pre-existing conditions not disclosed

Note: Batteries, fuses, bulbs, and consumables are non-returnable unless defective.

5. Emergency & Mobile Services

  • Response time for emergency calls in Nairobi is typically 30–90 minutes, depending on location and traffic.
  • A service call-out fee may apply for mobile visits (waived if repair/service is performed).
  • We are not liable for delays caused by extreme weather, road closures, or force majeure events.

6. Customer Responsibilities
You agree to:

  • Provide accurate vehicle details (make, model, year, symptoms)
  • Ensure safe and legal access to your vehicle (e.g., not double-parked or in restricted zones)
  • Disclose known issues or prior repairs
  • Be present or authorize a representative during service

7. Limitation of Liability
While we exercise due care, Zabeel Cars and Accessories LLC shall not be liable for:

  • Indirect, incidental, or consequential damages (e.g., loss of income due to vehicle downtime)
  • Damage caused by pre-existing faults not identified during initial diagnostics
  • Issues arising from non-genuine parts installed by third parties

Our total liability for any claim related to our services shall not exceed the total amount paid by you for that service.

8. Data Privacy
We collect and process your personal data (name, phone, vehicle details) solely to deliver services, comply with Kenyan law, and improve customer experience.

  • We do not sell your data to third parties.
  • Your data is stored securely in compliance with the Kenya Data Protection Act, 2019.
  • You may request access, correction, or deletion of your data by emailing us.

9. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Republic of Kenya.
Any dispute shall first be resolved through good-faith negotiation. If unresolved, parties agree to mediation through the Nairobi Centre for International Arbitration (NCIA) before pursuing court action.

10. Changes to These Terms
We may update these Terms periodically. The latest version will be posted on zabeel.ke/terms with an updated “Last Revised” date. Continued use of our services constitutes acceptance of changes.
